Terms
Service provider: Sole proprietor Arsen Martirosyan · Tax ID 49709571
These terms govern the use of webmall.am. By registering and sending an application you accept them. The agreement is a contract for paid services (Civil Code of Armenia, Articles 777–781).
The service
- We provide a ready online store with the chosen modules, hosting, security updates and backups.
- The store is available at name.webmall.am or on your own domain once it is verified.
- The service runs for the paid period (30 or 365 days), or without an end date where we grant it.
Agreement and payment
- We review and approve the application, then you pay. We may reject an application and tell you why.
- Payment, cancellation and refunds are described on the Payment page.
Your obligations
- Sell only goods and services allowed by law and hold the required permits.
- Give accurate information about yourself, your store and your products.
- Be responsible to your buyers for products, delivery and returns, including under the Law of Armenia on Consumer Rights Protection.
- Process your buyers' personal data under the Law of Armenia on Protection of Personal Data. You are the controller of that data; we store it on your instructions.
- Keep your account password safe and do not share access with others.
Our obligations
- Keep the store running, updated and backed up.
- Answer your questions in Messages in your account.
- Tell you in advance about planned maintenance and changes to the terms.
- We do not review your store content, but we act when we learn of clearly unlawful content.
Suspension and ending
- When the paid period ends, the store is no longer available to buyers. We keep the data for 30 more days so you can renew.
- For a serious breach of the terms (for example prohibited goods or fraud) we may suspend the store and tell you.
- You may cancel the service at any time (Civil Code, Article 780).
Liability
- We are liable only for failing to perform, or performing improperly, through our fault. We are not at fault if we took every measure within our control (Civil Code, Article 417(1) and (3)).
We are not liable for:
- the content of your store, your products and prices, or transactions between you and your buyers;
- actions of you or your staff, or the consequences of losing your password or sharing it with others;
- failures of services outside our control: banks and payment systems, domain registrars, your internet connection;
- non-performance caused by force majeure, meaning extraordinary circumstances that could not be prevented in the given conditions (Civil Code, Article 417(3));
- lost profit: lost income, sales or business reputation.
Limits and compensation:
- Our total liability does not exceed what you paid for the store concerned in the 12 months before the damage arose (Civil Code, Article 17(1)).
- If the store is down through our fault, we compensate by extending the paid period by the length of the outage, rounded up to a whole day.
- You compensate damage caused to us by your store's content or activity, including third-party claims.
- We keep backups, but we recommend exporting your data regularly from the admin panel.
- Send claims through Messages in your account or by e-mail within 30 days of discovering the problem.
- These limits do not apply to wilful breach (Civil Code, Article 417(4)) and do not restrict a consumer's rights guaranteed by law.
Changes and disputes
- We announce changes to the terms by e-mail at least 14 days in advance. If you do not agree, you may cancel under the rules on the Payment page.
- The law of the Republic of Armenia applies. Disputes are settled by negotiation, and failing agreement by the courts of Armenia.
